Amgen Legal Counsel in Shanghai, China
Role Purpose :
The focus of this position is on supporting the growing business operations of Amgen’s operations in China. The lawyer taking this role will be an advisor on a variety of general operating issues and commercial transactions, including general corporate governance matters, sales, marketing, R&D, and distribution matters, joint ventures, and collaborations involving biotech and pharmaceutical products.
This role would directly report to Legal Director of China, based in Shanghai also.
Key Accountabilities/Responsibilities :
Establish, review and improve legal-related policies and/or procedures periodically regarding the business operations in his/her responsibility to ensure the procedures and/or policies in line with the development of business operation, the guideline of global policies and applicable laws and regulations. Proactively contribute from legal perspective to company-wide and cross-function projects, process optimization and operating model changes Engage business leaders (function heads and director level) to promote risk prevention mindset for daily business operations. Draft and/or review of contractual arrangements, including distributorships, supply and discounting agreements, contracts for goods and services, clinical trials, and agreements with healthcare professionals; Advise sales, marketing, medical and access teams on development of programs and execution of activities Support complex commercial and strategic transactions (JVs, collaborations, co-promotion and co-development, licensing, etc.) Advise on policies, programs and conduct training, including competition law and anti-corruption/anti-bribery regimes. Support department head on government investigation and risk management, if needed. Handle local legal disputes through negotiation, mediation or litigation. Monitor thorough understanding of the legal development, perform legal research, communicate with various government authorities to understand the most recent regulatory developments, and advise various functional departments on the legal interpretation, implications and opportunities for the company’s operations
Law degree from recognized university law faculty. At least 8 years’ experience in reputable law firm or multi-national company;
Familiar with operations of pharmaceutical industry. Working experiences of both Pharmaceutical and prominent law firm are preferred Fluency and prior work experience in both English and Chinese languages is required. Excellent written and verbal communication skills. Contract drafting skills and knowledge of general commercial law, labor law and dispute resolution. Strong interpersonal skills, judgment, maturity and flexibility. Ability to manage competing priorities and provide high level of services across multiple stakeholders. Ability to operate both independently and as part of a larger in-house legal and compliance groups. Willingness to travel when business needs. Experience implementing compliance policies, programs and training; experience with relevant regulations and industry codes of conduct is preferred Self-motivated, hard-working, detail-minded, clear thinker, quick learner, team player and ability to work independently under pressure with minimum supervision
